The consolidated text of the Law on Civil Liability and Insurance in the Movement of Motor Vehicles, approved by Royal Legislative Decree 8/2004 of 29 October, provides in its article 49.1 that the compensation amounts of the system for the valuation of damages caused to persons in traffic accidents set out therein are automatically updated with effect from 1 January of each year, in the percentage of the general index of consumer prices for the calendar year immediately preceding.
To this end, the second paragraph of Article 49.1 provides that the Monitoring Commission of the Valuation System shall carry out the calculations referred to in the preceding paragraph and these shall be made public by decision of the General Directorate of Insurance and Pension Funds on the websites of the Ministry of the Presidency, Justice and Relations with the Courts and of the General Directorate of Insurance and Pension Funds to facilitate their knowledge and application.
According to data published by the National Institute of Statistics, the general index of consumer prices for 2025, which is applicable for the updating of the compensation amounts in force in 2026, is 2.9 per cent. This Directorate-General for Insurance and Pension Funds agrees to make public on its Internet portal http://www.dgsfp.mineco.gob.es/, the amounts of compensation applicable during the year 2026, once updated in accordance with that percentage.
Against this decision, which does not put an end to the administrative procedure, an appeal may be lodged within one month, which may be submitted to the General Directorate of Insurance and Pension Funds or to the State Secretariat for Economic Affairs and Support of the Enterprise, and this body is competent to resolve it, in accordance with articles 121 and 122 of Law 39/2015 of 1 October 2015 on the Common Administrative Procedure of Public Administrations.
