A documented situation to understand the criminal process.
Judgment of acquittal appealed; outcome of unverified appeal
One person was accused of causing injury. The existence of the assault and the identification of its perpetrator should be examined separately.
After assessing accounts, police intervention and expert evidence, the court found insufficient evidence of the accused person’s involvement. It acquitted and made no party-specific costs order. An appeal against acquittal was admitted; its outcome has not been verified.
Accrediting injuries is not enough to attribute them to a particular person. The relevant contradictions and the lack of corroboration must be assessed together; they do not allow the credibility of other complaints to be generalized.
