Supreme Court case law

Collecting a pension after concealing a death

One case of The Criminal Chamber related to criminal services.

Supreme Court · Second Chamber (Penal) · 2017

ECLI:ES:TS:2017:2360 · Date of resolution: 13/06/2017

What the Supreme Court considered and decided

The Supreme Court upheld a continuing-fraud conviction against a person who concealed the pension recipient’s death and withdrew the payments. Failures in administrative and banking checks did not remove the significance of the deception.

What this helps explain

The failure to verify the paying entity does not necessarily eliminate the deception that the author has created.
