Robbery: agreement, suspension and later remission of the sentence

A documented situation to understand the criminal process.

Judgment based on agreement to the prosecution case and subsequent order for remission of sentence reviewed

The situation

A trial of robbery with violence ended with compliance. In addition to setting the penalties, the court examined individually whether the prison of each convicted person should be suspended.

What the decision records

The judgment convicted for robbery involving violence assessed as less serious. One person’s prison sentence was suspended subject to paying civil compensation and not offending again during the stated period; another person was refused suspension. After the period elapsed, a later order remitted the suspended sentence, finding no further offending.

What this helps explain

Suspension and remission of sentence are separate decisions and are taken individually. The referral under review relates to imprisonment: it does not itself provide evidence of the cancellation of a record or the termination of any other obligation.
